Article 1 - Purpose
These terms and conditions (hereinafter "T&Cs") govern the contractual relationship between C&V Baby in Provence (hereinafter "the Provider") and any individual (hereinafter "the Renter") making a reservation for baby equipment via the Provider's website. The Provider makes available to the Renter, for a determined period, one or more items or packs of premium baby equipment, under a short-term rental agreement. Confirming a reservation implies full and complete acceptance of these T&Cs.
Article 2 - Minimum rental period
All reservations require a minimum duration of two (2) nights. The online booking system automatically rejects any request shorter than this duration. The rental period is calculated from the day of delivery or pickup to the day of return or collection of the equipment.
Article 3 - Prices and progressive discounts
Prices are shown in euros inclusive of all taxes (TTC) per night, per item or pack, in accordance with the catalog in effect on the website at the time of reservation.
Progressive discounts for individual items:
- 1 to 4 nights: standard rate
- From 5 nights: 15% discount
- From 12 nights: 25% discount
Progressive discounts for packs:
- 1 to 4 nights: standard rate
- From 5 nights: 25% discount
- From 12 nights: 35% discount
The total rental amount is calculated automatically during the booking process and presented to the Renter before payment confirmation. The Provider reserves the right to modify prices at any time; ongoing reservations remain subject to the rates in effect at the time of their confirmation.
Article 4 - Delivery fees
Delivery is available to the address provided by the Renter during the booking process, within a maximum radius of thirty (30) kilometers from Sénas (13300). The distance is calculated automatically via the Google Maps Distance Matrix API.
- If the total rental amount is equal to or greater than €30: delivery is free.
- If the total amount is less than €30: a delivery fee of €0.50 per kilometer (round trip) applies.
- Beyond 30 km: delivery is not available. The Renter is invited to opt for free on-site pickup in Sénas.
On-site pickup in Sénas is available as a free alternative regardless of distance.
Article 5 - Security deposit
A security deposit is required for every reservation. It takes the form of a card imprint recorded securely via Stripe (SetupIntent). The deposit is never charged automatically.
The deposit amount varies depending on the item or pack rented, as indicated in the catalog.
The card imprint is automatically released three (3) days after the end of the rental period, unless damage is reported. In the event of damage, loss, or theft of the equipment, the Provider reserves the right to proceed with a partial or full capture of the deposit amount. This capture is triggered manually by the Provider after assessment of the damage and notification to the Renter.
Article 6 - Renter's responsibilities
The Renter agrees to:
- Use the rented equipment in accordance with its intended purpose and usage instructions;
- Maintain the equipment in good condition throughout the rental period;
- Return the equipment in the same condition as received, normal wear and tear excepted;
- Not sublet, lend, or transfer the equipment to a third party.
In the event of theft, loss, deterioration, or damage exceeding normal wear and tear, the deposit amount may be charged partially or fully to cover the costs of repair or replacement.
Article 7 - Equipment condition
Equipment is delivered clean, inspected, and in perfect working order. The Provider commits to supplying equipment that complies with applicable safety standards.
The Renter has twenty-four (24) hours after receiving the equipment to report any defect or non-conformity, by email or via WhatsApp. After this period, the equipment is deemed to have been delivered in good condition and in conformity with the reservation.
Article 8 - Cancellation
The Renter may cancel a reservation free of charge up to forty-eight (48) hours before the rental start date. A full refund is then issued.
For late cancellations (less than 48 hours before the start), the Renter is invited to contact the Provider via WhatsApp to find an amicable solution. Failing agreement, the Provider reserves the right to retain a portion of the reservation amount.
In the event of a no-show, the full reservation amount remains due.
Article 9 - Personal data
The Provider collects and processes personal data as part of reservation management. For all information regarding the collection, processing, and protection of personal data, the Renter is invited to consult the Privacy Policy accessible from the Provider's website.
Article 10 - Applicable law
These T&Cs are governed by French law. In the event of a dispute relating to the interpretation or execution of these conditions, the parties shall endeavor to find an amicable solution. Failing that, any dispute falls under the exclusive jurisdiction of the courts within the Provider's registered office jurisdiction.
Article 11 - Consumer mediator
In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, the Renter may use the mediation service offered by the Provider free of charge. The designated consumer mediator is:
